AI in dispute resolution: who uses it, for what, and the rules that apply
AI in dispute resolution mostly helps summarise, transcribe, research and route cases, not decide them. In CEDR’s 2025 audit, 59% of responding UK mediators had used AI, none with parties directly. Every mediation, ODR and court AI text we checked calls for human oversight, and from September 2028 EU consumer ADR bodies using automated decision-making must allow human review.

AI rules in dispute resolution: what each body has published
Nine bodies in this tracker, counting NCTDR and ICODR’s joint text once, have published guidance on AI use by arbitrators, mediators or parties. Two have arbitration rules that cover it: KCAB International’s 2026 Rules encourage tribunals to discuss AI use with the parties, and AAA’s AI Led Arbitration Rules govern its opt-in AI cases. Each entry is dated and sourced.
